Rotterdam (Netherlands) and Copenhagen (Denmark) – April 1st, 2026 – The non-profit foundation Stichting Onderzoek Marktinformatie (SOMI) has officially filed a class action lawsuit at the Copenhagen City Court against Meta, the owner of Facebook and Instagram. SOMI is acting as a group representative on behalf of minors and their parents in Denmark who have had their rights violated and suffered mental harm through the use of Facebook and Instagram.
Big Tech companies, like Meta, TikTok, and X (formerly Twitter), have been collecting personal data, manipulating what we see, and profiting from it. Often without our consent.
After a detailed introduction to the facts and legal issues, the court first stated that it considered itself to have international jurisdiction. Since the defendant is based in Ireland, the provisions of the Brussels I Regulation apply. In the opinion of the Senate, Article 7(2) of the Brussels I Regulation, which refers to the place of the harmful conduct, is relevant. The Senate does not agree with the defendant's view that the plaintiff association is asserting its own claim, as the basis for such an original association claim already appears questionable. In this respect, Article 7(2) of the Brussels I Regulation could be invoked, the requirements of which are also fulfilled in the court's view.
Rotterdam (Netherlands), Schleswig (Germany) – 23 February 2026 – The Dutch non-profit organisation ‘Stichting Onderzoek Marktinformatie (SOMI)’ has filed a second collective representation action for damages against Meta in Germany. The lawsuit is centred around the unlawful use of personal data collected from Instagram and Facebook users as well as non-users for the purpose of training Meta's AI systems.
On February 5, 2025, SOMI filed redress proceedings against X before the Kammergericht in Berlin. A hearing in the matter has now been scheduled. The hearing will be open to the public, and we cordially invite members of the press, interested participants, and the general public to attend.
