Appeal in SOMI's claim against TikTok
On April 10th, 2024, SOMI filed an appeal with the Amsterdam District Court against the judgment of January 10th on the non-material damages and the admissibility of other foundations in the collective claim against TikTok.
SOMI has expanded the group of defendants from two to six TikTok entities and expanded the group of victims that would be represented by SOMI in this action to all TikTok users, so not only children but also adults in the Netherlands who used TikTok after May 25th, 2018.
In the judgment of January 10th, the court ruled that a claim for compensation for non-material damage depends largely on the individual situation and that there are not sufficiently comparable claims. In this consideration, in our opinion, the court ignores the nature of the immaterial damage for which SOMI is claiming compensation.
The court also ignores the fact that SOMI has the largest support of the three foundations, also operates across borders and that the interests of the victims are better safeguarded at SOMI, because there are no interests of a financier to take into account. With the other two foundations, the judge previously ruled that their financing agreements did not meet the (WAMCA) requirements. In addition, SOMI believes that the foundations are not transparent about the support they have received and the conditions under which that support was obtained. For these reasons, SOMI requests the court to declare STBYP and SMC inadmissible and instead to appoint SOMI as the Exclusive Representative.
With this appeal, SOMI aims to claim €2.000 for children under the age of 13, €1.000 for 13-15 years old, €500 for 16-17 years old, and €350 for TikTok users above the age of 18.
