SOMI’s Appeal in the TikTok Case in the Netherlands
On April 2-3, 2025, SOMI will present its case before the Amsterdam Court of Appeal, challenging the judgment of January 10th, 2024 regarding non-material damages and the admissibility of other foundations in the collective claim.
SOMI represents the largest group of participants among the three foundations involved, as confirmed by the court. Moreover, SOMI operates across borders in the European Union, has no litigation financers, and ensures that the victims’ interests remain the priority.
With this appeal, SOMI has:
Expanded the group of defendants from two to six TikTok entities.
Expanded the group of victims to include all TikTok users in the Netherlands since May 25th, 2018 to include adults, not just children.
Challenged the court’s ruling that claims for non-material damages require individual assessment.
Challenged the court's ruling regarding the position of Exclusive Representative in this case.
SOMI is fighting for the following amount of financial compensation for TikTok users: €2.000 for children under 13 years old, €1.000 for children ages 13-15, €500 for children ages 16-17, and €350 for adults. This brings the total claim to over € 2.5 billion.

TikTok Claim in Belgium and Germany
SOMI is actively expanding its claim against TikTok beyond the Netherlands. On October 31st, 2024, we launched a collective claim in Belgium, followed by a collective claim in Germany on February 5th, 2025 and most recently, a cease and desist filing in Germany on March 6th.
These legal actions reinforce our commitment to protecting TikTok users' rights across Europe. For more details about these cases and registration links, please refer to the table below.
